O Governo de Mato Grosso do Sul aderiu ao contrato corporativo como forma de gerar economia aos cofres públicos. Na prática, trata-se de uma modalidade onde as compras e serviços contínuos podem ser adquiridos em maior proporção, ou seja, de forma conjunta entre secretarias, autarquias e fundações, trazendo economicidade e ganho de escala à administração.
Segundo o procurador Henri Ramalho, o novo decreto foi publicado para que o Estado possa se adequar às disposições da lei 14.133/2021, que versa sobre as licitações, contratos e compras públicas.
O contrato corporativo, conforme o decreto Nº 16.407 publicado no Diário Oficial do Estado, será gerenciado pela SAD (Secretaria de Estado de Administração) e poderá ser aplicado na aquisição de serviços relativos à limpeza, asseio e conservação e vigilância.
Manutenção de bens móveis e imóveis (com ou sem fornecimento de bens permanentes ou de materiais de consumo), compra de combustível, filtros, lubrificantes e reagentes, fretes e transportes de encomendas e de passagens aéreas e terrestres, entre outras atividades, também estão na lista.
“A PGE (Procuradoria-Geral do Estado) participou ativamente da edição deste ato normativo para dar segurança jurídica ao processo e garantir que ele seja passível de aplicação na prática”, explicou a procuradora Priscilla Gomes.
O titular da SAD poderá definir, por meio de resolução, outros serviços e fornecimentos contínuos que podem ser contratados sob a forma corporativa. Também poderá ser adotado modelo distinto, desde que demonstrada a impossibilidade de utilização da modalidade de compra coletiva na fase preparatória.
De acordo com o procurador André Lopes, que também participou da construção do texto do decreto, a medida pode trazer economia significativa aos cofres públicos.
“O serviço será contratado de maneira uniforme e prestado de forma equânime, beneficiando diretamente a população. Isso sem contar com a economia de recursos, que podem ser revertidos em outras áreas do Estado, também em favor do cidadão”, afirma Lopes.
Capacitação
Além de ter participado da elaboração do texto que estabelece os contratos corporativos, a procuradora Vanessa de Mesquita e Sá está realizando reuniões para disseminar informações e tirar dúvidas do corpo técnico do Estado. Outro procurador envolvido no processo de edição do normativo é Rafael Sanson, chefe da Coordenadoria da PGE.
A nova lei de licitações e contratos, promulgada em abril de 2021, substitui a Lei 8.666/93, a Lei do Pregão (Lei 10.520/02) e o regime diferenciado de contratações – RDC (Lei 12.462/11). Esta reformulação representa um marco na legislação brasileira, visando modernizar e tornar mais eficientes os processos de licitação e contratação no setor público.
